Program Terms and Conditions
These Program Terms and Conditions (Program Terms) apply when you purchase or participate in a program offered by Project: Reframe Pty Ltd trading as Kristal Leighton ABN 94 658 326 964 (we, our or us).
By purchasing or participating in a Program, you agree to be bound by these Program Terms and our General Terms and Conditions, and acknowledge that your personal information will be handled in accordance with our Privacy Policy.
The specific content, format, dates, duration, price, payment arrangements and access period for each program (Program) are described on the relevant Program page or at checkout at the time of purchase and form part of your agreement with us.
These Program Terms operate alongside our General Terms and Conditions. The dispute resolution and governing law provisions in the General Terms and Conditions apply to your participation in a Program. If there is any inconsistency between these Program Terms and our General Terms and Conditions in relation to a Program, these Program Terms prevail to the extent of the inconsistency.
Nature of our Programs
Our Programs may include educational content, written or audio materials, exercises, reflection activities, coaching, live or recorded sessions and other resources or activities described on the relevant Program page.
Not every Program includes every type of content or support.
Programs are provided for educational, coaching and general wellbeing purposes.
They do not provide medical advice, diagnosis or treatment and do not constitute psychological therapy.
Participation in a Program does not create a medical, therapeutic or clinical relationship with us.
You should seek advice from an appropriately qualified health professional about medical, mental health, nutritional or other health concerns requiring individual professional advice.
Your participation
Participation is voluntary.
You remain responsible for your own:
· physical, mental and emotional wellbeing;
· decisions, choices and actions;
· use of information provided through the Program; and
· decision to seek appropriate professional assistance where required.
Program content and coaching may support reflection, learning and behaviour change, but we do not guarantee any particular result or outcome.
If you are currently receiving care or treatment from a health professional, you may wish to discuss your participation in the Program with that professional where appropriate.
Our Programs are not an emergency, crisis or acute health service.
Program access and delivery
The Program will be delivered in the manner described on the relevant Program page at the time of purchase.
Programs may be delivered through third-party platforms.
Access to Program content is provided for the period specified at the time of purchase. Access may expire at the end of that period.
Where a Program has specified commencement or completion dates, those dates apply unless we notify you of a reasonable change.
You are responsible for ensuring that you have appropriate internet access and technology to participate in online Program components.
If a technical issue on our end prevents you from accessing a Program, please contact us at hello@kristalleighton.com.au and we will take reasonable steps to resolve the issue.
Fees and payment
Program fees and any available payment arrangements are stated at the time of purchase.
All prices are in Australian dollars unless otherwise stated.
Payment must be made in accordance with the payment arrangement selected at purchase.
Where payment remains outstanding, we may suspend access to the Program until payment is brought up to date.
Nothing in this section limits any rights or remedies available to you under the Australian Consumer Law.
Cancellations and refunds
You may stop participating in a Program at any time.
Stopping participation does not automatically create an entitlement to a refund.
Any Program-specific cancellation or change-of-mind refund terms stated on the relevant Program page at the time of purchase also apply.
Unless otherwise stated at the time of purchase, we do not provide change-of-mind refunds after Program access has been provided or the Program has commenced.
Nothing in these Program Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
If a Program fails to meet an applicable consumer guarantee, any remedy will be determined in accordance with the Australian Consumer Law.
Live sessions
If a Program includes live sessions, the dates and format will be provided as part of the Program.
Where reasonably necessary, we may change the date or time of a live session. If we do so, we will provide reasonable notice where practicable and arrange an alternative session, recording or other reasonable substitute where appropriate.
If you are unable to attend a live session, we are not required to provide an individual replacement session unless this is included in the Program description or otherwise agreed.
Group sessions and privacy
Some Programs may include sessions attended by more than one participant.
If you participate in a group session, you must respect the privacy of other participants and must not share personal information or experiences disclosed by another participant outside the session without their permission.
While we require participants to respect each other's privacy, we cannot guarantee that another participant will comply with this obligation.
You should therefore use your own discretion when sharing personal or sensitive information in a group setting.
Safety and disclosure
We respect the privacy of Program participants. However, we may use or disclose relevant personal information where you authorise us to do so, where disclosure is required or authorised by law, or where we reasonably believe disclosure is necessary to lessen or prevent a serious threat to the life, health or safety of you or another person, or to public health or safety, and the disclosure is permitted by applicable law.
Where appropriate, this may include disclosure to emergency services, an appropriate health professional or a nominated emergency contact, if one has been provided.
We will limit any disclosure to information that is reasonably necessary in the circumstances.
Nothing in this section makes a Program an emergency, crisis or monitoring service.
Recordings
Where a Program session will be recorded, we will tell participants before recording begins.
If you do not wish to appear or be heard in a recording, you may keep your camera and microphone turned off or leave the session before recording begins.
You should not disclose personal or sensitive information during a recorded session unless you are comfortable with that information forming part of the recording.
We may edit, restrict or withhold a recording where reasonably necessary to protect privacy or remove sensitive, inappropriate or unnecessary material.
You must not record Program sessions without our prior permission and the permission of any identifiable participant.
Behaviour
You must participate respectfully and must not:
· harass, threaten or intimidate another participant;
· engage in unlawful or harmful conduct;
· provide medical advice, diagnosis or treatment recommendations to another participant;
· interfere with or disrupt delivery of the Program; or
· infringe another person's privacy or intellectual property rights.
Where reasonably necessary, we may restrict or end your participation because of a material breach of these Program Terms, unlawful or harmful conduct, non-payment, or a material safety, privacy or security risk.
Where appropriate, we may first give you an opportunity to address a minor breach.
We may act immediately where conduct is serious or creates a material safety, legal, privacy or security risk.
Any refund or other remedy following termination will be determined having regard to the circumstances, the services already provided and applicable law.
Changes or cancellation by us
We may make reasonable changes to Program content, scheduling, delivery methods or supporting materials where necessary to deliver the Program effectively.
We will not make a change that materially reduces the core Program you purchased without providing an appropriate alternative or remedy where required by law.
If we permanently cancel a Program and cannot provide a reasonable alternative, we will provide any refund or other remedy required by applicable law for the part of the Program that cannot be supplied.
Intellectual property
All Program materials remain our intellectual property or the intellectual property of our licensors.
Your purchase gives you a personal, non-exclusive, non-transferable licence to access and use the Program materials for your own private use.
You must not reproduce, distribute, sell, share, sublicense or make Program materials available to another person without our written permission.
Privacy
We handle personal information, including health information where relevant, in accordance with our Privacy Policy.
If you choose to provide health or other sensitive information as part of your participation, that information will be handled in accordance with our Privacy Policy and applicable privacy and health-records laws.
