DIGITAL PRODUCTS Policy

Project: Reframe Pty Ltd trading as Kristal Leighton ABN 94 658 326 964 (we, our or us) offers digital products including audio programs and associated materials (Digital Products) through our Site and platforms used by us to provide services. These terms operate alongside our General Terms and Conditions and Privacy Policy, available on our website. In the event of any inconsistency between this Digital Products Policy and the General Terms and Conditions, this Digital Products Policy prevails to the extent of the inconsistency for Digital Product purchases.The specific content, format and delivery schedule of each Digital Product is described on the relevant product page at the time of purchase. Access to Digital Products is provided for the period specified at the time of purchase. We are not obligated to provide access beyond that period.

When you purchase a Digital Product:

• Payment is processed at the time of purchase. All prices are in Australian dollars (AUD).

• Delivery is digital. On completion of purchase you will receive access to your Digital Product via a private link or download. During business hours, delivery is typically immediate. Outside business hours, delivery may take up to 24 hours. 

• For gifted Digital Products, delivery is made to the purchaser. The purchaser is responsible for delivering access to the intended recipient.

• Please read all product descriptions carefully before purchasing.

Our Digital Products are intended for general educational and wellbeing purposes only. They do not constitute medical advice, diagnosis or treatment. If you have a health condition, please consult an appropriate health professional before use.

Technical Issues

If you experience a technical issue that prevents you from accessing your Digital Product, please contact us at hello@kristalleighton.com.au and we will work to resolve it promptly.

To the maximum extent permitted by law, we make no representations or warranties about our Digital Products beyond those required by the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law.

Chargebacks

If you have a concern about a purchase, please contact us at hello@kristalleighton.com.au before initiating a chargeback or payment dispute with your financial institution. Initiating a chargeback without first contacting us constitutes a breach of these terms. We will always work to resolve genuine issues promptly.
 

Prohibited Use

You must not use any Digital Product or its content for commercial purposes, including reselling, sublicensing or using the content to create competing products or services. Access to a Digital Product is granted for your personal use only and may not be shared, transferred or resold to any third party.

Force Majeure
We will not be liable for any delay or failure to deliver a Digital Product where that delay or failure is caused by circumstances beyond our reasonable control, including but not limited to third party platform outages, telecommunications failures, or other events outside our control. Where such circumstances arise, we will take reasonable steps to notify you and resolve the issue as soon as practicable.

Refunds

Under the Australian Consumer Law, you are entitled to a remedy if a Digital Product has a major failure, is not as described, or cannot be accessed due to a fault on our end. If this happens, please contact us at hello@kristalleighton.com.au and we will make it right.

Beyond your statutory rights, we do not offer refunds for change of mind once access to the Digital Product has been provided.

Intellectual Property

All Digital Products and their content remain the intellectual property of Project: Reframe Pty Ltd trading as Kristal Leighton. On purchase you are granted a personal, non-transferable licence to access and listen to the Digital Product for your own private use only. You must not reproduce, share, distribute or make available any Digital Product or its content to any third party.

Indemnity

By purchasing a Digital Product you agree to indemnify and hold harmless Project: Reframe Pty Ltd trading as Kristal Leighton against any claim, loss or liability arising from your use of the Digital Product or any breach of these terms.
 

Amendments

We may, at any time and at our discretion, vary this Digital Products Policy by updating it on our Site. Changes will not affect the terms that applied at the time of your purchase. Check back to find the current Digital Products Policy.

Governing Law

These terms are governed by the laws of Victoria, Australia.
